Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of a revision appeal, thereby upholding the Kammergericht's 2022 judgment on a matter with a subject matter value of €42,772.18 and ordering the defendant to bear the costs of the complaint proceedings, including those incurred by the plaintiff's intervening auxiliary. The dispute concerned a civil matter where the defendant sought to challenge the lower court's refusal to admit an appeal to the Federal Court of Justice. The BGH declined to provide a detailed reasoning, invoking § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such an explanation would not contribute to clarifying the prerequisites for admitting a revision.
