Waiver of reasoning for denied leave to appeal and cost allocation in ZPO complaint proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-acceptance complaint, leaving the 16th Civil Senate of the Cologne Higher Regional Court's order of February 3, 2021, refusing to allow an appeal on points of law, in force. The dispute concerned a civil matter with a subject value of €868,180.64, where the plaintiff challenged the lower court's refusal to admit a revision appeal. The court relied on § 544 (6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), dispensing with a written rationale as it would not contribute to clarifying the conditions for admitting a revision, and ordered the plaintiff to bear the costs of the complaint proceedings, including those arising from the defendant's auxiliary intervention.
