The German Federal Court of Civil Procedure (BGH) dismissed the defendant's complaint for non-acceptance of revision, thereby upholding the Regional Court of Appeals' decision not to allow a further appeal; the complaint was brought by the defendant's auxiliary parties (with one auxiliary party bearing its own costs) against a final appellate ruling that was otherwise affirmed. The dispute involved a civil matter concerning a claim valued at approximately €812,191, where the procedural challenge focused on the prerequisites for granting leave to appeal to the supreme court. The court ordered the dismissal without providing a reasoned judgment, citing that a statement of reasons would not contribute to clarifying the conditions under which a revision (appeal) is admissible, in accordance with § 544 Abs. 6 Sentence 2, second half-sentence ZPO and § 97 Abs. 1 ZPO regarding the allocation of costs.
