Leave for Revision in Civil Proceedings: Justification of Refusal Without Reasoning under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the appellate court's refusal to grant leave for revision, leaving the lower court's judgment in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil matter where the plaintiff sought to challenge the appellate decision rendered by the Higher Regional Court of Braunschweig, which had previously denied leave for revision. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, determining that providing a detailed explanation for the dismissal was not suitable for clarifying the prerequisites for granting leave for revision, and relied on § 97 Abs. 1 ZPO for the cost allocation.
