Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice rejected the defendant's complaint against the non-admission of revision, thereby upholding the appellate court's order and leaving the lower instance judgment in force; the defendant bears the costs of the complaint proceedings. The dispute arose from a civil matter involving a disputed value of €29,880, where the defendant challenged the Regional Court of Appeal's decision not to allow an appeal on points of law to the Supreme Court. The court’s decisive legal basis was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, under which a reasoned explanation for the dismissal was dispensed with because such an explanation would not contribute to clarifying the prerequisites for admitting revision, resulting in an automatic rejection of the complaint.
