Admissibility of constitutional complaint against denial of revision leave in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the appeal for leave to appeal against the refusal to permit a revision by the auxiliary intervener, thereby upholding the lower court's decision and leaving the prior judgment in force; the intervener bore the costs of the appeal proceedings. The dispute arose in an infringement proceeding where the intervener challenged the Stuttgart Higher Regional Court's denial of revision leave, with a subject matter value of €200,000. The court applied § 544(6) sentence 2, second half-sentence ZPO to deny a reasoned order, determining that such a justification would not contribute to clarifying the conditions under which a revision is admissible, and analogously applied § 97(1) ZPO for cost allocation.
