Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) rejected the defendant's non-acceptance complaint, thereby upholding the Higher Regional Court of Munich's decision not to permit the admission of a revision appeal and leaving the lower court's ruling in force; in doing so, the court deemed a written reasoning unnecessary as it would not contribute to clarifying the statutory prerequisites for admitting revision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, and ordered the defendant to bear the costs of the complaint proceedings while the intervenor bears their own costs; the dispute concerned a civil matter with a subject matter value of €687,260, where the defendant challenged the procedural prerequisite for federal court review without successfully demonstrating a ground for admission.
