Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of an appeal, thereby upholding the Munich Higher Regional Court's decision and leaving the first-instance judgment in force; the defendant bears the costs of the complaint proceedings, with a subject matter value of €82,680. The dispute concerned a civil matter where the defendant challenged the appellate court's refusal to admit revision, but the BGH declined to provide a written reasoning as it deemed such a statement unnecessary for clarifying the prerequisites for admitting an appeal. The decision relies on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO for the omission of grounds and § 97 Abs. 1 ZPO for the cost allocation.
