Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the defendant's complaint regarding the refusal of the Court of Appeal to admit the revision appeal, upholding the prior procedural decision and awarding costs to the plaintiff; the value in dispute was set at €121,126.02. The case involved a civil dispute where the defendant sought to challenge a lower court ruling via revision, but the appellate court initially declined to admit the appeal for lack of a sufficient justification of error or significance. The decision was rendered without written reasoning, as the court determined that such an explanation would not contribute to clarifying the legal prerequisites for admitting a revision appeal. The decisive legal basis was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits the omission of a statement of reasons in complaint proceedings concerning the admission of revision when such reasoning offers no clarifying value regarding the standards for admissibility.
