Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Civil Procedure (BGH) dismissed the defendant's complaint against the non-admission of revision to the Federal Court, leaving the appellate court's decision from the Munich Higher Regional Court in force, with the defendant bearing the costs of the proceedings and the amicus curiae bearing its own costs. The dispute involved a civil matter with an object value of 206,500 EUR, where the lower court had previously refused to admit the case to the BGH for further review. The court declined to provide a detailed legal justification, citing Section 544(6) Sentence 2 Second Half-sentence of the German Code of Civil Procedure (ZPO), which permits omitting the reasoning when it would not contribute to the clarification of the preconditions for admitting revision.
