Waiver of reasoning in complaint against denial of leave for revision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the defendant’s complaint against the Munich Higher Regional Court’s order denying leave to appeal, thereby upholding the lower court’s decision and leaving the original judgment in force; the defendant and the third-party intervener each bear their own costs, with a subject matter value of €31,172.68. The case involved a civil dispute where the defendant challenged the admissibility of a revision appeal, which was previously rejected by the 28th Civil Senate of the OLG Munich on January 29, 2024. The BGH applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, deciding that providing a detailed reasoning would not contribute to clarifying the prerequisites for admitting a revision, thus dispensing with a written justification.
