Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (7th Civil Senate) dismissed the plaintiff's complaint against the lower appellate court's refusal to admit a revision appeal, leaving the prior order in force and condemning the plaintiff to bear the costs of the complaint proceedings; the court explicitly waived a written reasoning as it would not contribute to clarifying the prerequisites for admitting revision. The dispute involved a civil matter with a subject matter value of €343,009.74, where the plaintiff challenged the procedural decision denying access to the supreme court instance. The decisive legal basis was § 544 Abs. 6 Satz 2, second half, ZPO, which permits the court to omit a detailed justification for dismissing a non-admission complaint if such justification is deemed unnecessary for defining the conditions under which a revision appeal is admissible.
