Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of revision, thereby upholding the appeal court’s judgment and ordering the plaintiff to bear the costs of the complaint proceedings; the value in dispute was set at €95,171.47. The case involved a civil dispute where the plaintiff sought to challenge a final judgment from the 14th Civil Senate of the Oldenburg Higher Regional Court, but the BGH declined to provide a detailed reasoning as it was deemed unlikely to clarify the requirements for admitting revision. The decision was rendered based on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits the court to dispense with reasons for a dismissal if such reasons would not contribute to clarifying the criteria for admitting revision, with costs allocated pursuant to § 97 Abs. 1 ZPO.
