Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (BGH) 7th Civil Senate dismissed the defendant's complaint for non-acceptance of leave to appeal, thereby confirming the lower court's refusal to admit the revision and leaving the judgment of the Oberlandesgericht Naumburg of June 7, 2024, in force. The dispute, involving a claim worth approximately €551,794.71, centered on a civil liability matter where the defendant challenged the appellate court's decision not to grant leave for a further appeal. The court ordered the defendant to bear the costs of the complaint proceedings and waived the written justification for the decision, as it deemed the grounds insufficient to clarify the prerequisites for admitting a revision under § 544 para. 6 sentence 2 second alternative ZPO.
