Legislator-Zusammenfassung

The Federal Court of Justice (BGH), 7th Civil Senate, dismissed the defendant's complaint against the refusal to allow revision by the Munich Higher Regional Court, thereby upholding the prior instance's procedural ruling and leaving the defendant to bear the costs of the proceedings. The dispute concerned a civil matter with a value in dispute of €92,716.62, where the defendant challenged the lower court's decision not to admit a further appeal (revision). The court applied Section 544(6) Sentence 2, second alternative, of the Code of Civil Procedure (ZPO), determining that the conditions for a written justification were not met because the explanation would not contribute to clarifying the prerequisites under which revision must be admitted, and applied Section 97(1) ZPO for cost allocation.
