The Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of a revision appeal, thereby leaving the judgment of the Upper Regional Court (OLG) in force; the plaintiff prevailed in no respect, as the higher court declined to review the lower court’s decision. The dispute concerned a civil matter adjudicated by the 7th Civil Senate, where the plaintiff challenged the procedural decision not to allow a further appeal to the supreme court. Relying on § 544(6) Sentence 2, Second Alternative ZPO, the court abstained from providing a substantive written reasoning, determining that such an explanation would not contribute to clarifying the requirements for admitting a revision; consequently, the plaintiff was ordered to bear the costs of the complaint proceedings, with the amount in dispute capped at €30,000.
