Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-allowance of revision filed against the appellate court's decision, thereby leaving the second-instance judgment in force and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute, valued at €100,000, involved a civil matter where the plaintiff sought to challenge the refusal of the Oberlandesgericht Nürnberg to admit the appeal on points of law. The court dismissed the complaint without providing a detailed substantive justification, invoking the statutory provision that omits reasoning when it would not contribute to clarifying the prerequisites for allowing a revision, while basing the procedural dismissal on the specific rules governing leave to appeal and cost allocation in civil procedure.
