The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of the legal appeal (Revision) and ordered the plaintiff to bear the costs of the complaint proceedings, leaving the lower court's judgment in force. The case involved a dispute valued at €68,326.03 where the plaintiff challenged the 6th Civil Senate of the Higher Regional Court Dresden's refusal to grant the higher instance review. The court denied a written justification for the dismissal pursuant to § 544 (6) sentence 2, second half-sentence, and § 97 (1) of the Code of Civil Procedure (ZPO), determining that providing reasons would not contribute to clarifying the prerequisites for admitting an appeal.
