Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) 7th Civil Senate dismissed the plaintiff's complaint against the non-allowance of revision in a judgment by the 10th Civil Senate of the Stuttgart Higher Regional Court, leaving the lower court’s decision in force and ordering the plaintiff to bear the costs of the complaint proceedings; the court explicitly waived the provision of a detailed reasoning under Section 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), as such an explanation would not contribute to clarifying the conditions for admitting an appeal. The dispute involved a civil matter with an amount in dispute of €396,361.43, where the plaintiff challenged the appellate court’s refusal to grant permission for a constitutional-level review based on alleged procedural or substantive errors, but failed to demonstrate sufficient grounds for revision under the relevant ZPO provisions.
