Omission of reasoning on complaint against non-admission of revision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (7th Civil Senate) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the appellate court's decision and leaving the lower instance judgment in force; the defendant bore the costs of the complaint proceedings. The dispute concerned a civil matter where the plaintiff sought enforcement or relief, with the appellate court (28th Civil Senate of the Munich Higher Regional Court) having initially refused to permit an appeal to the highest court. The court declined to provide a detailed written justification under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such a reasoning would not contribute to clarifying the prerequisites for admissibility of a revision, relying instead on the standard threshold for exceptional importance or contradiction with prior jurisprudence.
