Legislator-Zusammenfassung

The BGH 7th Civil Senate dismissed the plaintiff's complaint against the non-admission of a Revision appeal, leaving the decision of the Cologne Regional Court of Appeals, which refused to allow the appeal to the Federal Court of Justice, in force; the plaintiff bears the costs of the complaint proceedings, with a subject matter value of €60,478.78. The dispute concerned a civil matter where the plaintiff challenged the appellate court's refusal to open the legal route to the supreme court, without the BGH providing a detailed substantive reason as it determined that an explanation would not contribute to clarifying the prerequisites for admitting Revision under § 544(6) sentence 2, second half-sentence ZPO. The decisive legal basis is § 544(6) ZPO regarding the criteria for admitting Revision and the power to dispense with a reasoned judgment when such a reason is unnecessary for legal development, alongside § 97(1) ZPO for the allocation of litigation costs.
