Non-allowance of revision in civil dispute: sufficiency of reasoning for clarification of admission prerequisites
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-allowance of revision, thereby upholding the appellate court's judgment in its favor, with the plaintiff bearing the costs of the proceedings. The dispute concerned a civil matter with a value in dispute of 888,000 euros, where the plaintiff sought to challenge a decision by the Fifth Civil Senate of the Oberlandesgericht Düsseldorf. The court refused to provide a reasoned decision pursuant to Section 544(6) sentence 2, second half-sentence, of the Code of Civil Procedure (ZPO), determining that such reasoning would not contribute to clarifying the prerequisites for allowing revision.
