The German Federal Court of Justice (BGH) dismissed the debtor's complaint against the non-admission of revision, thereby upholding the judgment of the Frankfurt Higher Regional Court (OLG) and leaving the creditor in possession of the contested assets; the value in dispute was fixed at 29,843.45 EUR. The case concerned an insolvency avoidance action (*Insolvenzanfechtung*) where the insolvency administrator sought to recover assets that had been gratuitously transferred to a third party, who subsequently passed them on to a legal successor, and the core legal issue was whether § 822 BGB (unjust enrichment at the expense of a third party) could be applied to claim restitution from that successor. The BGH held that § 145(2)(3) InsO provides a complete and exclusive statutory regulation for asserting avoidance against legal successors in cases of gratuitous transfer, thereby precluding the concurrent application of § 822 BGB. The Court reaffirmed established jurisprudence that § 145 InsO is not applicable to claims involving money debts (*Geldsummenschulden*) where specific restitution in kind became impossible prior to the succession, and found no grounds for re-evaluating this doctrine as the appeal failed to demonstrate fundamental significance or the need for legal development.

BGH, Urteil vom 24. Juni 2003 - IX ZR 228/02, BGHZ 155, 199, 204 f; vom 9. Oktober 2008 - IX ZR 59/07, ZInsO 2008, 1202 Rn. 11 mwN; Jaeger/Henckel, InsO, § 145 Rn. 8; HK-InsO/Kreft, 6. Aufl., § 145 Rn. 8; Graf Schlicker-Huber, InsO, 2. Aufl. § 145 Rn. 7; Brinkmann in Kübler/Prütting/Bork, InsO 2008, § 145 Rn. 6).

3

Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbs. 2 ZPO abgesehen.
