Insolvency avoidance against tax authorities: Attributing creditor-disadvantaging intent knowledge to a different department of the same public entity via post-litigation information retrieval
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the non-admission complaint, thereby upholding the lower court’s refusal to allow an appeal to the Revisionsgericht, with the costs of the complaint proceeding borne by the defendant. The dispute concerned insolvency avoidance actions against a tax authority, specifically whether knowledge of the debtor’s intent to disadvantage creditors could be attributed to a different authority of the same public law entity that only acquired that information later, during litigation, for the purpose of asserting a set-off. The court held that once an authority utilizes the possibility to obtain information from other authorities of the same legal entity, the entire legally relevant knowledge of those authorities regarding the transaction is attributed to it, including knowledge of the creditor-disadvantaging intent at the time of the relevant insolvency law event. This legal determination relies on the doctrine of task-related functional and informational unity and the requirement of organizational capability to integrate information within the public law entity at the material time, even if the specific inquiry is conducted post-hoc during proceedings.
