Eligibility of second-instance counsel for legal aid representation in Federal Court of Justice appeals
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) granted the debtor legal aid for the intended appeal without a personal contribution and appointed a specialist attorney admitted to the BGH, but rejected the debtor's further request to have her second-instance local counsel appointed as the liaison attorney (Verkehrsanwalt) for the appeal proceedings. The dispute arose in insolvency proceedings where the debtor sought legal aid and specifically requested the appointment of her existing appellate counsel for the legal appeal (Rechtsbeschwerde) against a lower court decision. The court held that under Section 78(1) sentence 4 of the Code of Civil Procedure (ZPO), parties in BGH appeals must be represented by an attorney admitted to the BGH, and the appointment of a local attorney as a mere liaison is generally precluded because legal issues dominate the procedure, rendering communication with the opposing party of subordinate significance; the fact that the local attorney drafted the legal aid application was insufficient to constitute special circumstances justifying an exception.
