Liability of an engine manufacturer for intentional violation of food safety laws under § 823(2) BGB in conjunction with § 6(1), § 27(1) EG-FGV.
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's non-acceptance complaint, upholding the appellate court's judgment and leaving the burden of costs on the plaintiff. The dispute concerned a tort claim under § 823(2) BGB combined with the German Food and Feed Law, where the plaintiff alleged unlawful conduct by the defendant; however, the complaint failed because it did not demonstrate the fundamental significance of the legal issue or the relevance of the grounds for appeal. The decisive legal basis for the dismissal was the plaintiff's failure to sufficiently substantiate an intentional violation of law by the vehicle manufacturer that the defendant, identified as the engine manufacturer rather than the vehicle manufacturer, could have participated in, consistent with BGH jurisprudence (VIa ZR 1119/22). The Court further rejected the alleged violation of fundamental procedural rights as non-substantive and waived detailed reasoning pursuant to § 544(6) sentence 2 half-sentence 2 ZPO.
