Rejection of non-admission complaint due to insufficient demonstration of fundamental significance under Regulation 715/2007
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the regional appellate court's judgment and leaving the lower-instance decision in force. The dispute concerned the scope of application of Regulation (EC) No. 715/2007, with the plaintiff challenging the appellate court's refusal to admit a constitutional appeal based on the alleged fundamental significance of the legal questions raised. The court determined that the complaint failed because the plaintiff did not sufficiently demonstrate the relevance of the raised legal issues under Article 3 No. 10 of the aforementioned Regulation, rendering it unnecessary for the clarification of legal principles or the securing of uniform case law under § 543(2) sentence 1 No. 1 ZPO, and the plaintiff was ordered to bear the costs of the complaint proceedings.
