Liability of motor manufacturer for vehicle emissions violations under § 823(2) BGB and the sufficiency of proof of participation in an intentional legal violation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s non-admission complaint, thereby upholding the Munich Higher Regional Court’s decision that barred the plaintiff from proceeding to revision; the plaintiff bears the costs of the complaint proceedings. The dispute concerned a claim for damages under Section 823(2) BGB in conjunction with Sections 6(1) and 27(1) of the Road Traffic Licensing Regulation, brought by a plaintiff against a defendant motor manufacturer, who allegedly participated in a deliberate legal violation by a vehicle manufacturer. The court held that the complaint failed to demonstrate the decisional relevance of the grounds for admission because the defendant, as a motor manufacturer rather than a vehicle manufacturer, could not be held liable for the specific alleged intentional violation without sufficient proof of participation, and the claimed procedural rights violations were not upheld.
