Non-admission of revision: failure to demonstrate fundamental significance regarding absence of shut-off devices
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff’s complaint for non-admission of revision against a decision by the Cologne Higher Regional Court, leaving the lower court’s ruling in force and assigning the plaintiff the costs of the appellate proceedings. The dispute concerned civil litigation where the plaintiff attempted to establish the fundamental legal significance of specific questions regarding the absence of shut-off devices, but failed to demonstrate that the appellate court’s reliance on these factors created an open legal issue of national importance. The BGH held that the requirements for admitting revision under § 543 Abs. 2 Satz 1 ZPO were not met, as the arguments did not suffice to show that the case was necessary for the development of law or the assurance of uniform jurisprudence, and rejected the alleged violations of procedural fundamental rights.
