Insurance policy non-compliance with EU guidelines and Treu und Glauben: no referral to CJEU required, no fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of an appeal in revision, upholding the lower court’s decision and awarding costs to the defendant. The dispute concerned a property insurance contract, specifically challenging the clauses' compliance with EU insurance distribution guidelines and raising issues regarding the principle of good faith (*Treu und Glauben*). The court determined that the question of guideline conformity was not decisive for the outcome and, citing precedent, held that a preliminary reference to the Court of Justice of the European Union regarding the *Treu und Glauben* argument was unnecessary. Consequently, the court found no fundamental legal significance, need for legal development, or requirement for uniform jurisprudence under § 543(2) Sentence 1 ZPO to justify appellate review, ordering the plaintiff to bear the costs of the complaint proceedings under § 97(1) ZPO.
