Legislator-Zusammenfassung

KI-generiert

The Federal Labour Court (BAG) dismissed the defendant's revision and reversed the appellate court's judgment, effectively reinstating the first-instance decision in favor of the plaintiff and ordering the defendant to bear the costs of the appeal and revision proceedings. This decision constitutes an admission judgment (Anerkenntnisurteil) issued without a detailed statement of facts or reasons, resulting from the defendant's failure to respond to the revision complaint, which thereby waived the defense of the prior appellate ruling. The operative legal basis is the procedural default rule allowing the court to render a judgment on the basis of the plaintiff's claim and the defendant's inaction, specifically governed by the provisions on admission of claim in labor court procedure.
