Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Niedersachsen vom 5. August 2013 - 10 Sa 43/13 - aufgehoben.

Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Nienburg vom 22. November 2012 - 2 Ca 303/12 - abgeändert.
