The Federal Labour Court (BAG) dismissed the employer's appeal, partially modifying the lower court judgments to affirm the employee's claim for a monthly performance bonus. The dispute centered on the employer's obligation to pay a specific performance allowance for the period of July 2007 to August 2008 and to include this allowance in the calculation of continued monthly remuneration, additional vacation pay, and special payments. The court ordered the employer to pay the aggregate performance bonus of €303.53 gross, less any amounts already paid, and to factor this amount into the calculations under § 16 EMTV, § 14 Nos. 1 and 2 EMTV, and § 2 No. 2.2 ETV 13th-month income, thereby upholding the application of the collective agreement provisions regarding variable compensation components.
