The Federal Labour Court dismissed the defendant's revision, partially amending and partially upholding the lower court judgments to order the employer to pay a monthly performance allowance of €552.67 gross (net of prior payments) for the period from July 1, 2007, to August 31, 2008, and to include this amount in the calculation of continued wages, holiday pay, and the 13th-month bonus. The dispute centered on the employee's entitlement to a collective agreement-based performance allowance and its statutory integration into other remuneration components under the relevant collective bargaining agreements. The court relied on the interpretation of the specific collective agreement clauses regarding performance allowances and the legal obligation to account for such payments in the base figures for calculated benefits and bonuses.
