Legislator-Zusammenfassung

KI-generiert

The Federal Labour Court (BAG) upheld the first-instance judgment, reversing the regional appellate court's decision and ordering the defendant employer to pay the plaintiff employee, thereby finding in favor of the employee. The dispute concerned the validity of a fixed-term employment contract under the German Part-Time and Fixed-Term Employment Act (TzBfG), specifically whether a "household" or administrative reason constituted a sufficient objective justification for a fixed-term duration without a specified end date. The court determined that such a household-based time limit was legally permissible under the doctrine of objective fixed-term contracts, and because the legal conclusion required no further elaboration, the decision was issued as a confession judgment (Anerkenntnisurteil) without a statement of facts or reasons.
