Correction of patent nullity judgment tenor and cost allocation under § 95 PatG for errors in claim limitation
Legislator-Zusammenfassung
KI-generiertThe Federal Patent Court (BPatG) issued an order correcting the tenor and cost allocation of its previously pronounced judgment in a patent nullity case, declaring European Patent No. 1,043,858 partially null and void in Germany by limiting its valid claims to independent claims 12 and 18, while apportioning litigation costs 75% to the plaintiff and 25% to the defendant. The dispute concerned the validity of the European patent, with the defendant defending only auxiliary claims 12 and 18, but the original judgment erroneously omitted this restriction and provided an incomplete cost assessment for the third-party intervention. The correction was ordered under § 95(1) German Patent Act (PatG), which permits the senate to rectify evident clerical errors in the operative part of a judgment at any time to align the text with the actual legal reasoning and oral hearing protocol.

In der Patentnichtigkeitssache
hat der 5. Senat (Nichtigkeitssenat) des Bundespatentgerichts am 26. Juli 2021 durch den Vorsitzenden Richter Voit, die Richterin Martens sowie die Richter Dipl.-Geophys. Univ. Dr. Wollny, Dipl.-Phys. Univ. Bieringer und Dr.-Ing. Ball
beschlossen:
