Effect of opposition withdrawal on appellate proceedings and legal force of lower instance decision in trademark cancellation cases
Legislator-Zusammenfassung
KI-generiertThe Federal Patent Court of Justice ordered that the appeal instance decision of the Trademark Office is legally ineffective, effectively resolving the proceedings in favor of the trademark proprietor whose mark had previously been ordered for cancellation. The dispute arose in a trademark opposition and appeal proceeding concerning the conflicting word marks "Club Bier" and "Club," where the Trademark Office had initially rejected the opposition but subsequently ordered the cancellation of the attacked mark upon reconsideration following an objection by the opposing party. In the appellate proceedings before the Federal Patent Court of Justice, the opponent voluntarily withdrew the opposition during the oral hearing. Based on § 82(1) Sentence 1 of the German Trademark Act in conjunction with §§ 269(3) Sentence 1 second half-sentence and 269(4) Sentence 1 of the Code of Civil Procedure, the Court declared the lower instance decision ineffective ex officio for reasons of legal certainty and the ex officio principle, and dismissed the request for cost allocation under § 71(1) and (4) of the Trademark Act.
