Narcotics sentencing: Irrelevance of minor quantity excess to verdict when mitigation precludes judicial error
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the Landgericht Berlin's conviction and leaving the imposed unconditional custodial sentence of two years and three months in force. The case involved a narcotics offense where the defendant challenged the sentencing, specifically the aggravation based on the quantity of drugs exceeding the threshold for a "not small amount," while also raising issues regarding diminished capacity and the execution of a security custody measure. The court ruled that the finding of diminished capacity due to drug addiction under § 21 StGB did not prejudice the defendant, that a review of the probation of the security custody measure was unnecessary given the unconditional prison sentence under § 67b StGB, and that even if a "minor excess" of the quantity threshold under § 29a Abs. 1 Nr. 2 BtMG could theoretically constitute a mitigating factor, it did not affect the outcome of the judgment.
