Conflict of measures under § 55 Abs. 2 StGB vs. § 67f StGB: Maintaining prior detoxification placement when all offenses predate earlier judgment
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Court (BGH) rejected the defendant's appeal as unfounded but modified the judgment by vacating the newly ordered measure of placement in a detoxification facility, thereby upholding the measure previously ordered by the Berlin Regional Court in a separate 2015 conviction. The case involved drug offenses where all adjudicated acts predated a prior 2015 judgment, and the dispute centered on the correct application of total sentencing rules to concurrent measures of correction and prevention. The court held that under the priority of § 55 Abs. 2 StGB over § 67f StGB, when all offenses precede an earlier judgment, the previously ordered measure remains in force and any newly ordered measure in the subsequent judgment must be annulled, while affirming that the lower court's refusal to order advance execution of a portion of the total custodial sentence was legally sound.
