Unappealability of regional high court decisions in prosecution enforcement proceedings under § 304(4) sentence 2 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice dismissed the complainant’s further complaint as inadmissible at the complainant’s own expense, leaving the regional high court’s earlier decision in force. The dispute concerned the procedural validity of an appeal against a regional high court order that had rejected a judge’s recusal motion for bias during a public prosecution enforcement proceeding (*Klageerzwingungsverfahren*). Relying on Section 304(4) sentence 2 of the Code of Criminal Procedure, the court held that decisions by regional high courts are generally unappealable, and this principle applies even in prosecution enforcement cases where the regional high court acts in the first instance, as it does not have jurisdiction to conduct the main trial or render a final judgment; consequently, no statutory provision allows for the review of such recusal-related orders in this context.

Zwar sieht § 304 Abs. 4 Satz 2 2.
