Inadmissibility of self-standing confiscation in a psychiatric commitment proceeding under § 413 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Appeal (BGH) partially granted the defendant's revision, ordering the reversal of the lower court's confiscation decision while dismissing the remainder of the appeal and upholding the mandatory psychiatric commitment; consequently, the commitment order remains in force, but the confiscation is void. In a protective custody proceeding under the Code of Criminal Procedure, the Regional Court of Frankenthal had ordered the defendant's placement in a psychiatric hospital and the self-standing confiscation of seized knives and tools, a ruling challenged by the defendant's motion for revision. The court held that the self-standing confiscation of objects under § 76a Para. 2 Sentence 1 No. 2 in conjunction with § 74 Para. 2 No. 2 and Para. 3 of the German Criminal Code cannot be rendered in a protective custody proceeding pursuant to § 413 StPO; such measures require a separate application in an independent confiscation proceeding under § 440 Para. 1 StPO, which was not filed, rendering the confiscation legally deficient due to a lack of procedural prerequisite.

Einziehung eines Gegenstands: Einziehung bei Durchführung eines Sicherungsverfahrens
[TENOR]
