Criminal appeal: admissibility of challenging the failure to evaluate a preliminary expert report as a violation of the duty of comprehensive evidence assessment
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice (BGH) dismissed the defendants' appeals as unfounded, affirming the lower court's judgment and ordering each appellant to bear their own legal costs. The dispute centered on a criminal revision where one defendant alleged that the regional court violated the principle of exhaustive evidence evaluation by relying solely on the final expert testimony while ignoring a prior preliminary report that deviated on a material point. The court held that the specific ground of appeal regarding the non-consideration of the preliminary report was procedurally inadmissible because the revision failed to establish whether the preliminary report was actually introduced as evidence during the main hearing, a prerequisite for assessing a violation of the court's duty to evaluate all results of the main proceedings under § 261 and § 267 of the Code of Criminal Procedure.

BGH, Urteil vom 9. Mai 2006 - 1 StR 37/06; NStZ 2006, 650).
