Assessment of value in dispute: constitutional requirement to account for actual economic significance falling below statutory capital value in rental property disputes
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's application for review, upholding the panel's earlier determination of the value in dispute, thereby leaving the plaintiff in the more favorable position regarding the assessed financial stakes of the litigation. The dispute concerned the procedural assessment of the "Streitwert" (value in dispute) in a real estate case involving the rental of a specific land parcel, where the defendant challenged the calculation of the fee-relevant value. The court held that while § 6 ZPO generally prescribes the statutory calculation method, constitutional requirements mandate a deviation in cases where the specific circumstances clearly demonstrate that the actual economic significance for the plaintiff is substantially lower than the calculated capital value; applying this doctrine, the court fixed the value well below the 200,000 € threshold, focusing on the plaintiff's limited interest in renting the property rather than its full asset value.
