No remote effect of evidentiary exclusion from failure to inform co-defendant of right to refuse testimony
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice dismissed the defendant's revision against a conviction by the Magdeburg Regional Court, leaving the lower court judgment in force and ordering the defendant to bear the costs of the appeal. The dispute centered on whether the lower court violated evidentiary exclusion rules due to a failure to inform a third party, who was the defendant's roommate and alleged brother, of the right to refuse to testify during a preliminary investigation. The court held that any such violation regarding the duty to inform under § 52 Abs. 3 Satz 1 StPO would lack "remote effect" (Fernwirkung), meaning it did not preclude the use of narcotics evidence later discovered during a search of the defendant's room, citing established doctrine that such procedural errors do not taint subsequently obtained physical evidence. Crucially, the appellate court noted that the trial court’s conviction was based exclusively on independent physical evidence rather than the statements of the uninformed witness, further validating the admission of the materials.

Es kann dahinstehen, ob es sich bei dem Mitbewohner des Angeklagten namens Y. N. tatsächlich um einen leiblichen Bruder handelt, denn ein möglicher Verstoß gegen die Belehrungspflicht gemäß § 52 Abs. 3 Satz 1 StPO hätte keine Fernwirkung gehabt und würde daher einer Verwertung der bei der späteren Durchsuchung des Zimmers des Angeklagten erlangten Beweismittel nicht entgegenstehen (vgl. BGH, Urteil vom 28. April 1987 – 5 StR 666/86, BGHSt 34, 362, 364 [zu einem Verstoß gegen § 136 Abs. 1 Satz 2, § 163a Abs. 3 Satz 2, § 243 Abs. 4 Satz 1 StPO];
Urteil vom 24. August 1983 – 3 StR 136/83, BGHSt 32, 68, 71; Urteil vom 22. Februar 1978 – 2 StR 334/77, BGHSt 27, 355, 358; OLG Köln, Beschluss vom 10. November 2000 – Ss 462/00, NZV 2001, 137; Meyer-Goßner/Schmitt, StPO, 59. Aufl., § 52 Rn. 32, SSW-StPO/Eschelbach, 2. Aufl., § 52 Rn. 68 mwN).
