Admissibility of criminal appeal restricted to non-imposition of preventive detention for lack of injury
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Revision (BGH) dismissed the defendant's appeal as inadmissible, leaving the lower court's conviction and the decision not to order preventive detention in place. The defendant challenged the regional court's refusal to order placement in a detoxification facility under § 64 StGB, arguing that the court's factual finding that therapy would offer no prospect of success was erroneous. The BGH held that an appeal restricted solely to the non-imposition of a protective measure is inadmissible for lack of injury (Beschwer), as such a measure restricts personal liberty rather than imposing a criminal penalty. The court further noted that the lower court's reasoning for abstaining from the measure was legally sound and free of error.

KI-generiertCited in the reasoning regarding the admissibility of the appeal restriction, though the strict instruction to use only dispositive citations renders this exclusionary; however, as no other provisions are cited in the dispositive, and § 349 StPO is the underlying procedural basis for the admissibility check mentioned in the cited case law, it is often implicitly the basis, but strictly following the 'literally appears in dispositive' rule: The dispositive states 'als unzulässig verworfen' without citing a specific StPO article. The cited case law in the reasoning references StPO § 349. Since the prompt says 'Do not include provisions that appear only in the reasoning', and the dispositive itself does not contain '§ 349', I must return an empty list.

September 2000 - 4 StR 314/00, BGHR StPO § 349 Abs. 1 Unzulässigkeit 2; vom 10. Januar 2008 - 4 StR 665/07 Rn. 2, NStZ-RR 2008, 142; vom 2. Dezember 2010 - 4 StR 459/10 mwN, NStZ-RR 2011, 255 und vom 5. April 2011 - 3 StR 102/11; Urteil vom 2. Oktober 2013 – 1 StR 75/13, NStZ-RR 2014, 43).
