Validity of appeal withdrawal made during plea bargain in a separate criminal proceeding
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice ordered that the defendant bear the costs of his legally effective withdrawal of appeal, thereby dismissing the challenge and leaving the lower court’s conviction in force. The dispute centered on the validity of a defendant’s withdrawal of a pending appeal against a final judgment, which was executed orally during plea bargain negotiations (Verständigung) in a separate criminal proceeding before a different regional court. The Court held that such a withdrawal is irrevocable and legally binding, concluding that the withdrawal cannot be deemed ineffective merely because it was made in the context of a plea bargain concerning a different case; doing so would violate the defendant's procedural subjectivity and right to influence the course of proceedings. The decisive legal basis is that a withdrawal of appeal under § 302 StPO is generally irrevocable, and by analogy to the prohibition on waiver after a plea bargain in the same proceedings (§ 302 Abs. 1 Satz 2 StPO) is not applicable to withdrawals made in unrelated proceedings, thus preserving the validity of the defendant's autonomous procedural act.

Eine Rücknahmeerklärung ist grundsätzlich unwiderruflich und unanfechtbar (st. Rspr., vgl. etwa BGH, Beschluss vom 22. September 1993 - 2 StR 367/93, BGHR StPO § 302 Abs. 1 Satz 1 Rechtsmittelverzicht 13; Meyer-Goßner/Schmitt, StPO, 58. Aufl., § 302 Rn. 9 f., 22 auch zu Ausnahmen). Es kann offenbleiben, ob sie tauglicher Gegenstand einer Verständigung sein kann (so KG, Beschluss vom 9. Dezember 2014 - 2 Ws 7/15, NStZ 2015, 236, 237). Denn selbst wenn man eine derartige Gesamtlösung unter Einbeziehung eines anderen Verfahrens für unzulässig hält (so ausdrücklich Knauer/Pretsch, NStZ 2015, 238;
BVerfG, Beschluss vom 12. April 1983 - 2 BvR 1304/80 u.a., BVerfGE 63, 380, 390; ebenso KG aaO, 238).
