Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice, First Criminal Senate, issued a reference decision rejecting the Second Criminal Senate's proposed ruling and affirming the First Senate's contrary precedent regarding pain compensation. The dispute concerned whether the personal and economic circumstances of the injured party or the tortfeasor must be considered when determining "fair compensation in money" under § 253(2) German Civil Code in the context of sentencing mitigation. The First Senate held that the Second Senate's approach, which excluded consideration of the parties' financial situations, conflicted with established jurisprudence. Relying on the binding guidelines of the Grand Senate for Civil Matters and the Sixth Civil Senate, the court mandated that these economic factors remain relevant in the assessment of equitable monetary compensation, thereby prevailing over the Second Senate's intent and preserving the First Senate's doctrinal position.

Zivilsenats vom 28. Juli 2015 – GSZ 1/14 (siehe auch Großer Senat für Zivilsachen des Bundesgerichtshofs, Beschluss vom 12. Oktober 2015 – GSZ 1/14).
