Diminished culpability and retained insight: evidentiary requirement for proving exploitation consciousness in treachery-based homicide and validity of psychiatric commitment based on alternative manslaughter offense
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice’s First Criminal Senate dismissed the accused’s appeal as unfounded, upholding the regional court’s final conviction and the order for commitment to a psychiatric hospital pursuant to § 63 StGB, thereby ruling in favor of the prosecution. The case involved a challenge to the regional court’s assessment of diminished culpability and its application of the murder special feature of "treachery" (Heimtücke), where the court had found that the defendant acted with the requisite exploitation consciousness despite a severe, delusional mental disorder that significantly impaired, though did not fully negate, his control capacity. The appellate court identified a gap in the lower court’s evidentiary reasoning regarding how the defendant’s specific delusional state affected his capacity to realistically perceive the situation, noting that while the legal principle that retained insight generally implies intact exploitation consciousness applies, the specific psychopathological circumstances required more detailed justification. However, because the regional court had correctly established the alternative offense of attempted manslaughter in concurrence with dangerous bodily harm, the underlying offense remained valid as a sufficient basis for the mandatory commitment to a psychiatric facility under § 63 StGB, rendering the error regarding the murder classification legally irrelevant to the final disposition.

August 2003 - 1 StR 327/03, NStZ-RR 2004, 10, 11, vom 10. September 2002 - 1 StR 337/02, NStZ-RR 2003, 11, 12 sowie vom 5. März 1999 - 2 StR 518/98).
