Termination of criminal appeal due to defendant's death: procedural impediment overriding prior rejection of revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Procedure (BGH) ordered the termination of the criminal proceedings against the defendant, rendering the previously issued decision to reject the defendant's appeal moot and ineffective with respect to the deceased accused. The dispute arose because the defendant passed away on April 7, 2015, prior to the appellate court's August 18, 2015 decision to dismiss the defendant’s revision (appeal) for lack of prospect of success under § 349 Abs. 2 StPO. The court held that the defendant's death constituted a procedural impediment (Verfahrenshindernis) requiring the formal termination of the case under § 206a StPO, rather than a simple dismissal of the appeal. Consequently, the state bears the procedural costs pursuant to § 467 Abs. 1 StPO, but is not required to reimburse the defendant's necessary expenses or compensate for investigative measures, as the rejected appeal had no prospect of success under § 467 Abs. 3 Satz 2 Nr. 2 StPO.

Strafverfahren: Einstellung des Verfahrens nach Urteilsverkündung
[TENOR]
1. Das Verfahren wird eingestellt.
BGH, Beschluss vom 13. Juni 2013 - 1 StR 207/13).
