Threshold for Preventive Detention: Unified Juvenile Sentence as Prior Conviction
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (4th Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and the conditional order of preventive detention. The dispute concerned a procedural objection regarding an expert witness report and the substantive legal basis for ordering preventive detention after the imposition of a unified juvenile sentence as a prior conviction in the context of a total sentence. The court held that the expert's oral testimony in the main hearing cured any prior defects in the written report, making the objection moot. Crucially, the Court ruled that under § 66 Abs. 3 Satz 1 StGB, the threshold for ordering preventive detention when a total sentence serves as a prior conviction is met if the total term is sufficiently high and based exclusively on catalog offenses, clarifying that a single component sentence of at least three years is not required. This standard applies equally to a unified juvenile sentence (Einheitsjugendstrafe) serving as the prior conviction.

Vorbehaltene Anordnung der Sicherungsverwahrung im Fall der Verhängung einer Einheitsjugendstrafe als Vorverurteilung
[TENOR]
November 2005 - 2 StR 272/05, BGHSt 50, 284, 293 f.).
